Intellectual Property Notice

All rights to the artwork created by Art By Heidi Lee (Heidi Lee Warta) shall remain the exclusive property of the artist, even after purchase. This applies to the acquisition of originals, commissioned pieces and prints, as well as any current or future reproductions in any format.

The purchase of any artwork, original or otherwise, does not confer upon the buyer the right to create an NFT (non-fungible token) of the piece, print and distribute it in any manner, or reproduce it in any way for profit or non-profit purposes.

It is expressly forbidden for collectors to reproduce the artwork in any way without obtaining the prior written consent of the artist. However, sharing images of the acquired items on social media platforms is highly encouraged and does not violate this stipulation as long as Heidi Lee Warta is tagged in the post.

Liability

Liability Disclaimer: Art By Heidi Lee strongly advises customers to thoroughly read and understand the product descriptions before making a purchase. We cannot be held responsible for compensating customers who fail to review the provided product information in the description. Please note that all prints are accompanied by a white border, which is NOT included in the final size as indicated in the listing, THE MEASUREMENTS ON THE PRINT LISTINGS ARE OF THE ARTWORK AND DO NOT INCLUDE THE 25mm AND 50mm WHITE BOARDER.

Once the goods are in the possession of the collector, Art By Heidi Lee cannot be held responsible for their condition. It is not our responsibility to offer refunds, exchanges, replacements, or any form of compensation for damages incurred due to mishandling by customers, such as smudges or fingerprints on the white border, or any damage caused to the artworks.

However, in accordance with consumer protection regulations, we do acknowledge liability for products that are damaged during transit by postal services or due to the dispatch of faulty merchandise.

Returns and Refunds

If there is any problem with your order, Art By Heidi Lee is committed to resolving the issue promptly. In case of any discrepancies or if the item does not meet your expectations, we will strive to rectify the situation. Please find the return policies for each product category below.

We uphold a 14-day return policy for eligible products which must be in the same condition as when you received it. While Heidi makes every effort to provide accurate colour representation of the artwork and all the artworks have been

sampled and tested by Heidi herself before printing, please note that device calibrations may vary as the prints will generally be darker than the screen. To ensure accurate colour assessment, we recommend viewing the item on multiple devices such as desktops, iPhones, as screens may be set on darker or lighter settings etc. All prints are created at Heidi’s preferred settings.

Fine Art Prints: All fine art prints are drop shipped to you from a reputable printing company that creates beautiful museum quality prints in Sydney Australia. Due to their delicate nature, most prints cannot be resold once you have received your order.

Original Artworks: All original purchases are considered final and will be packaged and sent with a personal thankyou note from Heidi and further packaged with Heidi’s proffered shipping company Pack and Send.

Change of Mind Purchases: We do not accept returns, refunds, or exchanges for change of mind purchases. As per Australia’s consumer protection laws, any shipping fees for returns made in good faith are the responsibility of the customer.

Shipping Policy

Address Change Policy: Once dispatched from the printing firm, we are unable to modify the shipping address.

Responsibility Disclaimer: Art By Heidi Lee is not accountable for undelivered packages resulting from inaccuracies in shipping addresses provided by the customer.

Customer Responsibility: Kindly ensure that you furnish accurate and complete mailing addresses during the checkout process to facilitate seamless delivery.

Duties and taxes

Location and Printing Information: Heidi operates from her studio on the Central Coast and the Northern Beaches. in New South Wales (NSW), Australia. Whilst all prints. are produced in Sydney, Australia.

Taxes and Duties Notice: Please note that any applicable taxes and duties are not included in the total checkout amount. These charges are determined by the customs agency of the destination country. Import taxes may be applicable in some countries while not in others.

Notification and Payment: The customs agency will inform the recipient, via mail, phone, or email, about any due charges. Payment of these fees is necessary for the shipment to proceed to its destination.

Customer Responsibility: It is the customer's responsibility to settle any duties, value- added tax, or similar charges. Failure to comply with these additional requirements may result in the return of the delivery to us.

Declaration Compliance: Items are declared at their purchase value for exportation, and we strictly adhere to NOT falsifying any documents under any circumstance.
